1. DEFINITIONS
“Phuket On Tours,” “we,” “us,” or “our” refers to Phuket On Tours, acting solely as a booking agent.
“Customer,” “guest,” or “client” refers to any individual or entity making a booking through Phuket On Tours.
“Services” refers to tours, transfers, activities, accommodation, or related travel services booked through third-party suppliers.
2. ROLE OF PHUKET ON TOURS
Phuket On Tours acts exclusively as an agent and intermediary for independent third-party service providers, including but not limited to tour operators, transport companies, accommodation providers, and activity suppliers.
Phuket On Tours does not own, operate, manage, or control any tours, vehicles, vessels, accommodations, or activities unless explicitly stated in writing.
3. BOOKINGS, AVAILABILITY & CONFIRMATION
3.1 Advance Booking Requirement
Bookings should be made at least 2–99 days prior to the tour date, and no later than 18:00 (office hours) 2 days before departure, in order to allow sufficient time to confirm seat availability with suppliers. If there are no seats available, we will let you know which dates are available for the tour you have chosen.
Availability is not guaranteed until written confirmation is issued and payment has been fully received.
3.2 Payment & Confirmation
Only fully paid bookings will be confirmed. Upon receipt of full payment, a booking confirmation and ticket voucher will be issued and sent via email, WhatsApp, or Facebook Messenger or any social media site you contact Phuket on tours on.
Unpaid or partially paid bookings do not constitute a confirmed reservation as the full amount needs to be paid first in order to confirm the booking. (2-99 days before departure)
3.3 Urgent & Last-Minute Bookings
For urgent or last-minute booking requests, customers must contact Phuket On Tours directly at +66619104754 or +66625151532 to verify availability before making payment.
Phuket On Tours shall not be liable for availability issues arising from payments made without prior confirmation for urgent bookings.
4. PAYMENTS
Full payment must be received prior to the customer’s arrival in Phuket unless prior written credit arrangements have been approved.
Failure to make payment by the required deadline may result in cancellation of services without notice, and applicable cancellation charges will apply.
All bank charges, transfer fees, currency conversion fees, and credit card processing fees are the sole responsibility of the customer.
5. TOUR INCLUSIONS & EXCLUSIONS
Only services expressly stated as included in the confirmed itinerary form part of the contract.
Any services or expenses not expressly included—including but not limited to additional meals, optional activities, visas, insurance, tips, or personal expenses—are excluded and remain the responsibility of the customer.
6. CHILD & INFANT POLICY
Child and infant rates are applied strictly according to age at the time of travel. Proof of age may be required. Incorrect age declarations may result in denial of service or adjustment to adult rates.
7. WEATHER, SAFETY & FORCE MAJEURE
Weather and sea conditions are beyond the control of Phuket On Tours and cannot be guaranteed.
Phuket On Tours relies on official announcements from the tour operators that rely on the Meteorological Department, Marine Authorities, and relevant government authorities. These announcements are made and checked up on for each tour.
Phuket On Tours shall not be liable for service disruptions caused by force majeure events, including but not limited to natural disasters, weather conditions, government actions, or safety decisions.
8. CHANGES & OPERATIONAL DECISIONS
Phuket On Tours and its suppliers reserve the right to amend itineraries, schedules, routes, or services at any time for safety or operational reasons. Such changes do not constitute grounds for compensation.
9. CANCELLATIONS & NO-SHOWS
Day Trips, Activities & Airport Transfers including all services offered by Phuket On Tours as a third party (agent):
No refunds will be provided for late arrivals, early departures, unused services, or failure to participate.
Medical claims must be supported by valid documentation and are subject to supplier approval.
10. REFUNDS
Approved refunds will be processed within 10–15 working days, subject to supplier confirmation and banking timelines.
Phuket On Tours shall not be responsible for delays caused by banks, payment providers, or third-party suppliers.
11. LIABILITY DISCLAIMER
To the fullest extent permitted by law, Phuket On Tours disclaims all liability for loss, injury, damage, delay, or expense arising from third-party acts, accidents, weather conditions, or force majeure events.
Participation in all tours and activities is undertaken at the customer’s own risk.
12. INSURANCE
Customers are strongly advised to obtain comprehensive travel insurance. Unless explicitly stated, Phuket On Tours does not provide personal insurance coverage.
13. PRIVACY & DATA PROTECTION
Personal data is collected solely for booking and operational purposes and handled in accordance with applicable data protection laws.
14. GOVERNING LAW & JURISDICTION
These Terms & Conditions are governed by the laws of the Kingdom of Thailand. Any disputes shall fall under the exclusive jurisdiction of Thai courts.
15. ACCEPTANCE OF TERMS
By submitting a booking request, making payment, or participating in services arranged by Phuket On Tours, the customer confirms acceptance of these Terms & Conditions in full.
